Terms of Service

In short: SmartLog helps prepare draft declarations, while the final decision — and responsibility for the filed declaration — is yours. The full text follows.

  1. 01

    Acceptance of terms

    By using SmartLog (the website, dashboard, calculator, API) you confirm that you have read and accept these Terms. If you do not agree, do not use the service.

    Registering, uploading documents, paying or any other use of the service constitutes acceptance. If you act on behalf of a company, you warrant that you are authorised to accept these Terms for it.

    What SmartLog is

    SmartLog is a software tool that helps prepare draft customs declarations: it extracts data from supplier documents, suggests TN VED codes and calculates estimated payments.

    SmartLog is not a customs broker or a representative before customs authorities and does not provide legal or tax advice. The output of the service is a draft document that requires human review.

  3. 03

    Accounts

    You must provide accurate information, keep your password secret and are responsible for all activity in your account.

    We may suspend or block access in case of breaches of these Terms, signs of fraud or a threat to the security of the service.

  4. 04

    Plans and payment

    Some features are available free of charge within limits. Limits and prices are published on the website and may change; changes take effect upon publication and do not affect volumes already paid for.

    Paid positions are prepaid; payments are processed by payment providers. Paid volumes are non-refundable unless otherwise required by law.

  5. 05

    Accuracy and your responsibility

    TN VED codes, payment amounts and draft declarations are recommendations produced by algorithms. The final decision on the code, the value and the content of a declaration is made by you (or your broker).

    The declarant is responsible for the filed declaration, the accuracy of its data and compliance with customs legislation. Decisions of customs authorities may differ from the service's calculations.

  6. 06

    Your data

    You retain all rights to the documents and data you upload. You confirm that you are entitled to upload them.

    You allow us to process them in order to provide the service, and to use anonymised “goods description → TN VED code” correspondences to improve classification quality. Details are in the Privacy Policy, which is an integral part of these Terms.

  7. 07

    Intellectual property and acceptable use

    The service, design, code, models and the classification database belong to us.

    • Do not copy or resell the service
    • Do not bypass limits or bulk-export data
    • Do not upload unlawful content or interfere with the service's operation
  8. 08

    Disclaimers

    The service is provided “as is” and “as available”. We do not guarantee uninterrupted operation, the absence of errors, the accuracy of classifications and calculations, or fitness for a particular purpose.

  9. 09

    Limitation of liability

    We are not liable for indirect losses: lost profit, fines, penalties, additional assessments by customs authorities, downtime or loss of data.

    Our aggregate liability for any claims is limited to the amount you actually paid for the service in the last 3 months. If you used the service free of charge, liability is zero. Nothing in these Terms excludes liability that cannot be excluded by law.

  10. 10

    Indemnity

    You agree to hold us harmless from third-party claims and to compensate losses arising from your documents, data, declarations or your breach of these Terms or the law.

  11. 11

    Changes to the terms and the service

    We may update these Terms and the service itself. The new version is published on this page; for material changes we will additionally notify you in the interface or by email. Continuing to use the service after changes means accepting the new version.

  12. 12

    Term and termination

    You may stop using the service and request account deletion at any time. We may terminate access in case of breaches of these Terms. Obligations that arose before termination (including payment) survive.

  13. 13

    Governing law and disputes

    The law of the Republic of Kazakhstan applies. Disputes are first resolved by negotiation (within 30 days), then in the courts of the Republic of Kazakhstan.

    These Terms are translated into several languages; in case of discrepancies between versions, the Russian version prevails.
